HOW TO CLAIM
The National Confectionery Wholesalers (hereafter referred to as "NCW") 2011 Reward Program commences on the 1st of August 2011 and concludes on the 4th of November 2011. Promotion is open to customers of NCW wholesalers who are invited to participate (hereafter referred to as "you", "customer" or "eligible business" as the case requires). After the conclusion of the NCW Power Brands Rewards Program on the 4th of November 2011, your local NCW wholesaler will provide you with a summary of your total purchases of the participating products and your relevant accumulated point score, together with a claim form. In order to qualify for a Reward you must earn a minimum of 3,000 points during the term of the Rewards Program through your local NCW wholesaler. You may only claim Rewards equal to the total value of all the points on the final statement supplied by your NCW wholesaler. You must choose your desired Rewards from within the brochure, then complete all relevant details, sign the form, attach a copy of the points statement and return it to your local NCW wholesaler. Alternatively you may complete the online claim form on www.powerbrands.com.au. Only an NCW wholesaler can supply and invoice the nominated Power Brands products and issue Power Brands points and supply rewards. All products providing entitlements must be paid for in accordance with your NCW wholesaler trading terms.
REWARD CLAIMS
Redemption 1 - In order to receive rewards before Christmas 2011, claims must be entered online by 11.59pm Sydney time on the 28th of October 2011. Alternatively claim forms must be requested, completed and returned to your local NCW wholesaler by the 21st of October 2011.
Redemption 2 - In order to receive rewards by February 2012, claims must be entered online by 11.59pm Sydney time on the 2nd of December 2011. Alternatively claim forms must be requested, completed and returned to your local NCW wholesaler by the 25th of November 2011.
If your claim is received after the first Redemption period and before the close of the claiming period on the 2nd December 2011, your rewards will be delivered by February 2012.
All Reward claims must be received by 11.59pm Sydney time on 2nd of December 2011. Any Reward claims received after this date are ineligible. All Reward claims remain the property of NCW. Rewards are not transferable or exchangeable and cannot be taken as cash. All unused rewards points are forfeited. All unused rewards points not redeemed before the close of the claiming period on the 2nd of December 2011 are forfeited and not carried over into 2012.
BONUS POINTS
100 bonus points will be awarded to any customer who claims online on the ‘Power Brands' website www.powerbrands.com.au. 100 bonus points will be awarded to any customer that updates their details online on the ‘Power Brands' website by including their email address.
DELIVERY
Rewards are normally delivered within 8 weeks from the end of the relevant claiming period, but all deliveries will be subject to any supplier conditions. If you receive any goods in a faulty or damaged condition please contact NCW Rewards Centre on 02 9854 9999 within 48 hours of receipt of those goods and provide details. All deliveries are prepaid but if there is any demand for a delivery charge, please pay that charge and retain the receipt and contact the NCW Rewards Centre for reimbursement.
TAXATION
Neither NCW nor participating NCW wholesalers provide any advice or give any warranty in relation to the taxation implications arising from any Rewards that you become entitled to under the Program. All Rewards are valued inclusive of GST. No taxation liability is accepted by NCW or the participating NCW wholesalers and we recommend that you obtain independent advice on your taxation position.
AUTHORITY TO RECEIVE REWARDS
All Rewards are issued on the understanding that the person claiming the Rewards has been authorised to do so on behalf of the participating eligible business. Nevertheless, Rewards claimed by registered clubs are subject to relevant registered and licensed club legislation in the various States and Territories of Australia, and Rewards must be paid out in a manner consistent with that legislation.
DISCLAIMER
NCW and the participating NCW wholesalers do not accept any liability in respect to loss, damage, death or injury, including consequential loss or damage arising from the supply of a Reward, or from the loss, theft or destruction of a Reward except for any liability which cannot be excluded by law. You may have some rights under the Competition and Consumer Act 2010 and there may also be some conditions or warranties implied by law which cannot be excluded, subject to these rights and implied conditions or warranties, both NCW and participating NCW wholesalers give no warranty with respect to the quality of the Rewards or their suitability or fitness for any purpose.
RIGHT TO AMEND PROGRAM
NCW and NCW wholesalers may, in their absolute discretion:
a) Change, amend or vary these Terms and Conditions;
b) Change, amend, vary, withdraw or cancel any Reward or the value of any Rewards;
c) Cancel this Program either in whole or in part;
d) Change, amend or vary a customer's qualification target or the participating Brands;
e) Exclude a customer from, or cancel a customer's registration and participation, in the Program.
If the customer is at any time during the continuance of the Program in breach of its trading terms, with NCW or with any NCW wholesaler, NCW may cancel the customer's registration and their participation in the Program. To the extent permitted by law, NCW and any NCW wholesaler are not liable for any loss or damage suffered which may result from any withdrawals, cancellations, variation or changes to the Program made by NCW or NCW wholesalers in accordance with these Terms and Conditions. All decisions pertaining to any disputes under this Program or on the interpretation of these Terms and Conditions will be made by NCW whose decision will be final and binding on all customers and binding on all NCW wholesalers.
EXCLUSION OR CANCELLATION
NCW and NCW wholesalers reserve the right at their absolute discretion at any time to exclude any customer from inclusion in the Reward Program or to cancel the registration of any customer.
GENERAL
Rewards will not be available until all claim forms are validated by the relevant NCW wholesaler. Further, Rewards are not transferable or redeemable for cash.
REWARDS
All Rewards are based on descriptions from information received from suppliers and manufacturers. Unless otherwise stated, installation and/or service of rewards is not included. However, guarantees by manufacturers still apply.
Discontinued or unavailable rewards may be substituted by NCW with a Reward of similar value at their absolute discretion. Any enquiries concerning warranty information applying to Rewards should be directed to the manufacturer. We recommend that you complete and forward the warranty information card contained with any Reward in accordance with the manufacturer's instructions.
PRIVACY
All details provided by an individual of the customer will be stored at the office of NCW, Suite 43, 255 Drummond Street, Carlton, Victoria 3053. Any request to access, update or correct any information should be directed to this address. By supplying the information, unless otherwise advised by the individual, each individual consents to the information which they submit with their claim form being entered into a database and for NCW and their promotional partners to use this information for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the individual.
ENTIRE AGREEMENT
These Terms and Conditions are the entire agreement between NCW, the NCW wholesaler and the customer unless otherwise altered by NCW and NCW wholesalers in accordance with these Terms and Conditions.
